Use of the Terramar Organics Website(s)

Important: please read the Terms and Conditions.

Viewing and use of this website www.terramar.co.uk constitutes implicit agreement by the user (You) to be legally bound by the Terms and Conditions including the Privacy Policy of Terramar Organics at www.terramar.co.uk. Unless otherwise stated, the contents of this website are the property of Terramar Organics (Us). This includes, but is not limited to, text, design, names, logos, graphics and layout of the website.

You may not use any domain owned or run by Terramar Organics for any other purpose than that intended by Terramar Organics. Accordingly, any attempt to manipulate underlying code or use of our form mail for any purpose other than that intended and clearly indicated in the page heading or content of the page will be regarded as abuse of Terramar Organics property and/or systems.

Attempting to send SPAM of any kind is abuse.

In the case of Terramar Organics form mail, SPAM shall be considered as any message containing link(s) to external sites of a dubious nature. These include sites offering medications, insurance, and content of a sexual nature; as well as link farms and 3rd party hosted sites were the underlying URL leads to a page with an embedded URL redirection script.

Payment

Goods are despatched on receipt of payment by Terramar Organics of the full price of the goods ordered.

We accept payments by debit and credit card via our payment provider, PayPal.

We also accept payment by cheque (GBP - Sterling only) and postal order (GBP - Sterling only).

All cheques and postal orders must be made payable to "Terramar Organics". Your order will be despatched when the cheque has cleared or the postal order cashed.

Upon receipt of payment an "Order Confirmation" email or letter will be sent to the email or contact address provided in the order form, and goods will be despatched. At this stage a legally binding contract shall exist between Terramar Organics and you, the customer.

Ownership

Ownership of the goods ordered shall pass from Terramar Organics (Us) to the customer (You) upon payment of the full price of the goods and receipt of the goods at the delivery address provided in the order form. After the expiry of 7 working days from receipt the order may not be returned or cancelled, unless otherwise authorised.

All goods remain the property of Terramar Organics until the full price has been paid for the goods and, in the case of payment by cheque or BACS, when the funds have been received by our bank.

if:

(A) the goods we delivered are damaged or defective or incorrect in any essential way e.g. colour, design, quantity, or
(B) you do not receive the goods within 14 days of the date on which you made the order.

If, in case (A), you do not notify us in writing within 10 days of delivery then we shall have no liability with you.
If, in case (B), you do not notify us in writing within 14 days of the date of your order then we shall have no liability with you.

Terramar Organics assumes no responsibility for consequential loss or damage.

Notices and Complaints

Unless otherwise agreed, all notices to Terramar Organics from you must be in writing and sent to us at:

If you have any cause for complaint, please contact Terramar Organics as soon as possible. We will examine the cause of the complaint and take action as appropriate, as and when required.

Changes to this website

Terramar Organics may make improvements or changes to the information, services, products and other materials on this website, or terminate this website at any time without notice. If, in the case that the website is terminated, all outstanding orders will be honoured. We may also modify these terms and conditions at anytime, and such modification shall be effective immediately upon posting of the modified terms and conditions on this website. Accordingly, your continued access or use of this website is deemed to be your acceptance of the modified terms and conditions.

Price

The price of the goods is displayed in the online catalogue and on each individual product page. The total cost of an order including postage and packing, and VAT, where applicable, is set out at the time of placing the order and is displayed in the shopping cart.

Orders delivered outwith the EU tax zone will not incur VAT, however import duties may be chargeable by the destination country, which you are responsible to pay for. Please enquire with your local tax and customs office for further information.

Delivery

Terramar Organics ONLY accepts orders for delivery within the United Kindom, to Europe (the EU), and North America (USA and Canada).

Goods will be delivered to the address given in the order form.

Unfortunately, we cannot guarantee delivery to all locations. You will be notified if there is a problem with your delivery address and a satisfactory solution will be found.

Goods will be delivered in approximately the number of working days as specified to you in your "Order Confirmation".

For orders with UK delivery Royal Mail's "recorded signed for" service is used. Therefore, delivery must be to an address where the delivery can be signed for.

Where possible, orders are despatched on the day of making the order and, on the next business day where it is not possible to despatch on the day of ordering.

Cancellation and Returns

You may cancel your contract with us at any time prior to the expiry of 7 working days from receipt of goods.

The contract shall be held to be cancelled upon receipt by Terramar Organics of a "Cancellation Notice" subject to the goods being returned to us in pristine and resaleable condition.

All goods ordered and subsequently cancelled must be returned to Terramar Organics in pristine condition. If goods are despatched and you subsequently cancel the order, but have not yet received the goods, you must NOT open the packaging and must return the goods within 5 working days to us at your own cost and risk.

Subject to receipt by Terramar Organics of a Cancellation Notice AND receipt of the returned goods in pristine condition, any sum paid to us in exchange for the goods ordered from us by you will be refunded to you via PayPal (if payment for your order was by this method, personal cheque (posted to the delivery address that you provided on your order form) or electronic fund transfer.

Terramar Organics reserves the right to cancel the contract between us and you, the customer, if we do not deliver to your postal location, or if we have insufficient stock to satisfy your order, or if we have made a typographical error which constitutes a fundamental error in your order e.g. the price, or if our software malfunctions.

As a general principle, providing goods are returned as sold, and we are notified within 7 working days, we offer a no quibbles returns policy. Where all or part of an order is returned you may either request a full or partial refund for the item(s) returned or request an exchange for another item(s) of equal value. Please do not hesitate to contact us if you have any questions.

Force Majeure

We shall not be liable for any circumstances beyond our reasonable control, which may result in damage to or defect of the goods, or cause delay or failed delivery, or result in any loss by you or any Third Party.

Such events include, but are not limited to, acts of terrorism, forces of nature, industrial disputes, strikes or insurgency.

Jurisdiction and Applicable Law

A legally binding contract shall exist between you (the customer) and us (Terramar Organics) upon receipt by you of the Order Confirmation and shall subsist until it expires as herein provided.


Terramar Organics is based in and operates in Scotland. The law governing the contract between us and you shall be Scottish Law and the Scottish Courts shall have jurisdiction to resolve any legalities and liabilities arising in connection with your use of this website and any contract arising therefrom.
